It's gotta be someone who barely knows either him or any of us who care about him. Even if it wasn't meant as a punishment, I could see someone thinking, like— it's objectively more fair to kill someone who had some responsibility for other deaths than someone who hadn't done anything.
Which, sure, makes sense in theory, but if they actually knew him or the people around him, they'd realize what an enormous blow that would be to morale and how ugly it'd inevitably get.
To be fair, the end of that last trial was such a damn mess that— I mean, it was real clear that you and me were standing up for him, but there was so much to be mad about that I dunno how obvious all the others were about it. So maybe they're underestimating.
